KV... collective agreement
FD... Freelance employee
ED... Real employee
The KV for bicycle messengers is negotiated by the trade union and the Chamber of Commerce and applies to the entire cycling service sector. The entire industry? Not entirely. Some companies employ their drivers on a free contract; the KV does not apply to these. Around two thirds of Radbots work as FD and - if you ask the companies - are also satisfied with it. In fact, you don't have to search long before you find an FD who says himself: “I don't need the collective agreement.”
If this FD works for Mjam, he realized after a quick look that as an FD he can earn more in one month than an ED while he can freely arrange his work. However, if he takes a closer and longer look and compares the two contracts calculated over a period of one year, an ED ratio with all the benefits of the collective agreement offers an equally high or higher salary, only with more security or less risk:
This is what the current KV 2020 offers:
- a minimum wage of 8,71 €/h
- Vacation pay and Christmas allowance
- 100% night supplement after 22:00
- 100% holiday supplement
- Special vacation days for relocations, weddings and deaths
- Mileage allowance of 0.14 €/km
The trade union goal of KV 2021**:
- a reduction in working hours of 38 hours with full pay compensation (KV 2020:1509€ gross excluding km allowance and supplements for 40 hours)
- 100% Sunday and public holiday supplement
- Mileage allowance of 0.38 €/km
- Daily allowances analogous to KV Kleintransport
OK, but why is this interesting for FD?
The answer for convinced FD, for whom flexibility is more important than his rights as an employee:
When we created the KV for Radbots in 2019, Mjam also changed the wage scheme for FD. On the one hand - it was said - in order to remain competitive with Lieferando, on the other hand, it was certainly also about preventing ED contracts from becoming more attractive. If we manage to implement our goals now, Mjam will probably have to get involved again and also raise the salary for FDs, or follow the recommendation in KV that we are calling for it**:
- Minimum wage of 9,50€
- If work is prevented due to illness or accident, 100% continued payment of remuneration from the first day
- night supplement, Sunday and public holiday supplement
